DO NOT RECOMMEND! SHADY COERCION WITH ANNUAL CONTRACTS BECOMING MONTH-TO-MONTH WITH NO NOTIFICATION! BLAME CASE ON "THIRD PARTY CARD SERVICER"
This is negative feedback strictly concerning my recent upsetting experience with this gyms attitude and policies towards membership agreements. I signed a 12 month, month to month contract with them on 3/15/2017 for $38 a month with first and last months payment as a downpayment on that date.
Upon reviewing my bank statement this week of 1/2019 it was brought to light that charges are still being debited against my account for the $38 a month. There has been no notification to me that this is occurring, other than the payments being directly withdrawn. No annual summary, no receipt of any kind. There has been absolutely no outreach from the gym or their billing department in any capacity to inform me of my continued charges except their continued monthly debiting.
After speaking with a rep on the phone I was told my contract was month to month. This left me wondering if I could have misremembered signing a contract for 12 months? Signing an open ended contract and forgetting about it is not the sort of mistake I make as the owner of a successful local medical clinic and a doctor.
When I returned today I was furnished with a copy of my contract with very confusing wording. On the document in clear bold font is our agreement to a 12 MONTH CONTRACT, written in and clearly stating "this is not a month to month program". In small language near the bottom right of the contract are several small highlighted boxes. Upon signing my contract THESE WERE INDICATED BY THE PERSON WHO REGISTERED ME AS MANDATORY TO MY SIGN UP PROCESS.
One of these is a "Roll Over" box. This gives them the right to turn your annual contract (which was clearly stated in the contract as not month to month) into a month to month contract with NO NOTIFICATION to you. No annual receipts, no monthly receipts, no notice of withdrawal, no indication whatsoever except making sure you scrutinize your banks statement. I take ownership of the fact I did not check my bank statements so thoroughly for charges from this company, but I did NOT expect my annual contract to become a month to month with my consent or notification.
When I was getting this cleared up with the young man working behind the counter today, he informed me that the reason why there is no receipt of withdrawal or annual receipt is because their card processing service is a third party entity and that they cannot control what they do. This feels like a weak excuse. When I was cancelling my "month to month" contract, it was indicated that I had not been at the gym 3 months or more when the reality was closer to 14 months. No effort to document or understand my experience was made.
I feel incredibly misled that I was not informed that option is voluntary and not mandatory and I certainly wish I had been informed that there would be NO annual renewal information and NO notification that my account type had changed. I would have taken my business elsewhere.
At this point I have not used their services for an estimated 13-14 months. There was no resolution, there was no explanation given for why I was misled. There was no interest in helping me understand why they do not have a third party seller that offers receipts, the whole experience was terrible.
All in all I am out approximately $342.
I always try to spend my dollar locally in contract to with a chain, but I will be taking any future business to a chain where the membership contracts are backed up by a corporate entity. My mother and father has been members at this gym for a decade and will be terminating their memberships as well.
This was not a gym membership I forgot about, this was a 12 month contract agreement as stated at the top of the agreement that was designed to allow a participant to be coerced into automatic monthly payments with NO NOTIFICATION.
